Xmodhub Game Modifier License and Service Agreement

This Agreement is entered into by and between you and Xmodhub Company, the service provider of Xmodhub Game Modifier, and has contractual effect. Please read all terms of this Agreement carefully. If you agree to this Agreement, you may continue to use the services provided by Xmodhub Game Modifier. Your clicking agree, accept, or next, or your registration for or use of Xmodhub Game Modifier, shall be deemed as your having read and agreed to sign this Agreement. If you are under the age of 18, please read this Agreement accompanied by your legal guardian, and you may use the Xmodhub Game Modifier services only after obtaining the consent of your legal guardian. You should also pay special attention to the terms on use by minors.

I. [Definitions]

1.1 This Agreement: refers to the body of this Agreement, user rules, the Xmodhub Game Modifier Privacy Protection Guidelines, and their revised versions. Once the above contents are officially published, they become an integral part of this Agreement.

1.2 User Rules: refers to announcements, prompts, notices, and similar content regarding Xmodhub Game Modifier that Xmodhub publishes and revises from time to time.

1.3 Xmodhub Game Modifier Service Provider: refers to Xmodhub Co., Ltd., which provides Xmodhub Game Modifier and its services to you, abbreviated in this Agreement as "Xmodhub" or "we".

1.4 Xmodhub Game Modifier: refers to the game modifier software and related documents developed and operated by Xmodhub.

1.5 Xmodhub Game Modifier Services: refers to the services provided to you by Xmodhub through Xmodhub Game Modifier.

1.6 You: also referred to as "player" or "user", refers to a natural person authorized to use Xmodhub Game Modifier and its services.

1.7 Single-Player Game Data: refers to all data of the copy of a single-player game that you purchase, download, and store in local files, as well as all kinds of data generated during your play of various single-player games, including but not limited to character data, virtual item data, and similar data.

1.8 AI Assistant: refers to the artificial intelligence question-and-answer function module embedded by XMod in the XModhub Game Modifier client, which provides users with automatic answer services for game guides and other information through open-source large model technology.

II. [Xmodhub Game Modifier Account]

2.1 If you need to use the Xmodhub Game Modifier services, you need to register for a Xmodhub Game Modifier account.

2.2 In accordance with the relevant requirements of national laws and regulations, you should complete real-name registration. During real-name registration, you should provide true, lawful, accurate, and valid identity information and other relevant information concerning yourself, and you must not conduct real-name registration using another person's identity information.

2.3 A Xmodhub Game Modifier account is the identifier and credential authorized by Xmodhub under this Agreement for your login to and use of Xmodhub Game Modifier and related services, and its ownership belongs to Xmodhub. You only enjoy the right to use the account under this Agreement. You must not provide the account to others for use in any manner, including but not limited to providing it to others for commercial use by transfer, lease, loan, or other means. Otherwise, any legal consequences and liabilities arising therefrom shall be borne by you, and Xmodhub has the right to take handling measures against your account, including but not limited to warnings, restriction or prohibition of use of all or part of account functions, deletion of the account and other related information, account suspension, and cancellation. All consequences arising therefrom shall be borne by you.

2.4 You fully understand and agree that Xmodhub has the right to verify, in accordance with the requirements of laws and regulations, whether the identity information provided by users during registration is true and valid, and shall actively take reasonable technical and management measures to protect the security and validity of user accounts. Users are obligated to properly keep their accounts and passwords and to use their accounts and passwords correctly and securely. If your account is found to possibly have abnormal circumstances or risks, Xmodhub has the right to re-verify your account in accordance with relevant laws and regulations. If either party fails to perform the above obligations, resulting in loss of account password, account theft, or similar circumstances that cause damage to the civil rights of users and others, that party shall bear the legal liabilities arising therefrom.

2.5 Account Security and Risk Control

2.5.1 You fully understand and agree that a Xmodhub Game Modifier account is for your own use only. You must not provide the account to any third party for use in any form, including but not limited to sharing, lending, leasing, transferring, selling, or authorizing others to use it, and you must not use another person's account to log in to or use our services.

2.5.2 To protect the security of your account and prevent risks such as fraud, malicious sharing, and account abuse, you agree and authorize Xmodhub to conduct security detection and risk assessment of your account login behavior. We may collect and analyze the following information: login device information, including device model and device identifier; login IP address; login geographic location, meaning the approximate region inferred from IP; login time; login frequency; device change circumstances; network environment changes; and similar information. The collection and use of the above information will comply with the relevant provisions of the Xmodhub Game Modifier Privacy Protection Guidelines.

2.5.3 When your account has the following abnormal circumstances, including but not limited to frequent logins from different devices or different IP addresses within a short period of time, abnormal changes in login geographic location, such as cross-region or cross-country changes, login behavior clearly inconsistent with your past habits, signs of being used by multiple persons or used in rotation, suspected leasing, lending, or transferring of the account, or other circumstances indicating that the account may not be controlled by you or may have security risks, Xmodhub has the right to take corresponding security measures based on the degree of risk, including but not limited to:

(1) Requiring you to conduct additional security verification, such as SMS verification or identity information verification;

(2) Temporarily restricting or prohibiting login to your account;

(3) Restricting the use of part or all functions of the account;

(4) Freezing the account until the risk is eliminated;

(5) Requiring you to contact customer service for manual verification.

2.5.4 After restrictive measures are taken against your account, you may apply through customer service to lift the restrictions. After verifying your identity, we will decide whether to lift the restrictions based on the actual circumstances. All losses caused by account restriction or use by others due to your own reasons, including but not limited to account sharing, lending, or leasing, shall be borne by you.

2.6 Where Xmodhub provides an account cancellation function, if you need to cancel your Xmodhub Game Modifier account, you may operate in accordance with the account cancellation guidelines provided by Xmodhub, and you should ensure that you satisfy the relevant account cancellation conditions announced by Xmodhub.

At the same time, you are specifically reminded that if you cancel your account, the value-added services under that game account will also be cleared. Accordingly, once you cancel your account, if there are unused value-added services under that account at that time, you shall be deemed to have voluntarily waived them, and Xmodhub has the right to clear all data under that account. The consequences arising therefrom shall be borne by you.

III. [Collection, Use, and Protection of User Information]

3.1 You agree and authorize Xmodhub to collect your personal information for the purpose of performing this Agreement. During your use of the Xmodhub Game Modifier services, Xmodhub will collect information that you actively provide when using the services or that is generated because of your use of the services in the ways specified in the Xmodhub Game Modifier Privacy Protection Guidelines, in order to provide and optimize our services and protect the security of your account.

3.2 Xmodhub respects and protects users' personal information and privacy. The collection, use, and protection of users' personal information by Xmodhub Game Modifier will comply with the provisions of the Xmodhub Game Modifier Privacy Protection Guidelines. If you have agreed that Xmodhub may process your personal information in accordance with the foregoing agreement or provisions and later withdraw your consent, according to law, your withdrawal of consent will not affect the validity of personal information processing activities already conducted based on your consent before the withdrawal.

IV. [Xmodhub Game Modifier Services]

4.1 Subject to your compliance with this Agreement and relevant laws and regulations, Xmodhub grants you a personal, non-transferable, and non-exclusive license to use the Xmodhub Game Modifier services. You may use the Xmodhub Game Modifier services only for non-commercial purposes, including:

(1) Receiving, downloading, installing, launching, upgrading, logging in to, and running Xmodhub Game Modifier;

(2) Setting a screen name, viewing user personal profiles, purchasing and using value-added services, using chat functions, and using social sharing functions;

(3) Using one or more other functions supported and permitted by Xmodhub Game Modifier.

4.2 You are solemnly reminded that Xmodhub Game Modifier does not provide any services for online games.

4.3 You fully understand and agree that the Xmodhub Game Modifier services do not provide downloads or activation of any games, nor do they sell any game keys (CDKEY). Before using the Xmodhub Game Modifier services, users should purchase and obtain the right to use the corresponding games by themselves and ensure that complete files of such games downloaded through lawful channels are stored in local files. Otherwise, Xmodhub Game Modifier will be unable to provide services to you.

4.4 Disclaimer Undertaking for Modification of Single-Player Game Data: Users should strictly comply with game rules formulated by single-player game developers and publishers and play games civilly. Use of the Xmodhub Game Modifier services may cause changes to single-player game data stored in your local files. If you choose to use the Xmodhub Game Modifier services, you agree to give Xmodhub an irrevocable undertaking that you will not require Xmodhub to assume any responsibility, including data restoration, compensation for losses, or similar liability, due to changes in single-player game data caused by your own use of the Xmodhub Game Modifier services.

4.5 Xmodhub's provision of Xmodhub Game Modifier services to users is itself a commercial activity. Users have the right to independently decide whether to pay corresponding fees according to fee-based items and fee standards determined by Xmodhub itself in order to obtain corresponding services. If you do not pay corresponding fees according to corresponding standards, you will be unable to obtain corresponding services.

You acknowledge and agree that changes and adjustments to fee-based items or fee standards are normal commercial activities, and you may not require Xmodhub to make compensation or indemnification because of changes or adjustments to fee-based items or fee standards.

4.6 AI Assistant Services

4.6.1 XMod provides the AI Assistant function, hereinafter referred to as "AI Assistant", to provide users with question-and-answer services for game guides and other information. The AI Assistant is technically supported by an open-source large model deployed by XMod itself, and obtains relevant information through access to third-party search interfaces to assist in generating answers. You understand and agree that content generated by the AI Assistant is produced entirely automatically based on artificial intelligence technology, and XMod makes no express or implied guarantee as to the accuracy, completeness, timeliness, reliability, or applicability of content generated by the AI Assistant.

4.6.2 Content Disclaimer. You fully acknowledge and agree that:

(1) AI large model technology has inherent limitations, including but not limited to potentially generating content that is not fully accurate, incomplete, outdated, or inconsistent with expectations, and potentially outputting replies inconsistent with your expectations;

(2) Information such as game guides generated by the AI Assistant is for reference only and does not constitute any form of professional advice or decision-making basis. You should independently decide whether to adopt relevant suggestions based on your own judgment and bear all consequences arising therefrom yourself;

(3) XMod assumes no legal liability for any direct or indirect losses arising from your reliance on or use of content generated by the AI Assistant, including but not limited to loss of game data, account bans, or impaired gaming experience;

(4) Content generated by the AI Assistant may involve relevant information about third-party games. XMod has not obtained authorization from any game developer or publisher, and you should independently judge and comply with the service terms and use rules of the relevant games.

4.6.3 User Compliance Obligations. When using the AI Assistant, you should comply with laws and regulations, public morals, and the relevant provisions of this Agreement, and must not use the AI Assistant to:

(1) Generate, disseminate, or store any content that violates laws and regulations of the People's Republic of China or contains illegal or harmful information;

(2) Upload, enter, or submit any content that infringes the lawful rights and interests of third parties, including but not limited to intellectual property rights, trade secrets, and personal information rights and interests;

(4) Use it for any commercial purpose or conduct any form of commercial exploitation.

4.6.4 Special Reminder on Game Compliance. You understand and undertake that when using the AI Assistant to obtain game guides and other information, you should comply with the official service terms, user agreements, and relevant rules of the games you play. The official terms of some games may prohibit or restrict the use of any third-party program, automation tool, or auxiliary software to obtain in-game information or guides. If your game account is subject to any penalty, including but not limited to account ban, data rollback, or function restriction, because your use of content generated by the AI Assistant violates official game rules, the relevant liability shall be borne by you, and XMod assumes no liability.

4.6.5 Service Suspension and Restriction. If you violate the AI Assistant use specifications agreed in this Agreement, XMod has the right, depending on the circumstances, to take one or more of the following measures: issue a warning, suspend or permanently terminate your permission to use the AI Assistant function, freeze or cancel your account, and pursue your corresponding legal liability. If your improper use of the AI Assistant causes any losses to XMod, you shall compensate for such losses.

V. [Software License]

5.1 Use of the Xmodhub Game Modifier services may require downloading and installing relevant software. You may obtain the software directly from relevant websites of Xmodhub Game Modifier, or obtain it from a third party authorized by Xmodhub. If you obtain it from a third party not authorized by Xmodhub, you will be deemed not to have obtained Xmodhub's authorization, Xmodhub cannot guarantee that the modifier can be used normally, and Xmodhub will not be responsible for losses caused to you as a result.

5.2 After a new version of the Xmodhub Game Modifier software is released, old versions of the software may become unusable. Xmodhub does not guarantee that old versions of the software will continue to be available or that corresponding customer services will be provided. Please check and download the latest version at any time.

VI. [User Conduct Rules]

6.1 You fully understand and agree that you must be responsible for all acts in your use of the Xmodhub Game Modifier services, including any content you publish and any consequences arising therefrom.

6.2 Except for using the Xmodhub Game Modifier services as agreed in this Agreement, you must not conduct any act that infringes the lawful rights and interests of any other third party, including but not limited to:

(1) Reverse engineering, decompiling, or disassembling the software;

(2) Using the software for any illegal activity or any activity that infringes the rights and interests of others;

(3) Interfering with or disrupting the normal operation of the services.

VII. [Intellectual Property]

7.1 Xmodhub is the intellectual property rights holder of Xmodhub Game Modifier. All copyrights, trademarks, patents, trade secrets, and other intellectual property rights and lawful rights and interests in Xmodhub Game Modifier are protected by laws and regulations of the People's Republic of China and corresponding international treaties. Xmodhub enjoys the above intellectual property rights and lawful rights and interests, except for rights that relevant rights holders should enjoy in accordance with law. Without Xmodhub's prior written consent, you must not commercially use Xmodhub Game Modifier in any manner.

7.2 If the Xmodhub Game Modifier services involve third-party intellectual property rights, before using the Xmodhub Game Modifier services, you should obtain valid authorization and consent according to the third party's requirements for such intellectual property rights. Otherwise, Xmodhub will refuse to provide services to you, liability for violation of corresponding requirements shall be borne by you, and Xmodhub has the right to provide your information to the third party.

7.3 Intellectual Property of Content Generated by the AI Assistant

7.3.1 Content generated by the AI Assistant, hereinafter referred to as "AI Generated Content", is produced automatically through artificial intelligence technology and does not constitute a work within the meaning of copyright law. The related rights and interests belong to XMod. However, if AI Generated Content is substantially similar to content to which a third party has lawful rights, the corresponding rights still belong to that third party. You must not use AI Generated Content for commercial purposes beyond those agreed in this Agreement or conduct any form of independent development or exploitation.

7.3.2 Questions, uploaded text, and other content you input when using the AI Assistant, hereinafter referred to as "User Input Content", remain the intellectual property of you or the relevant rights holders. You grant XMod a non-exclusive, free license valid during the period of service provision, allowing XMod to conduct necessary processing of User Input Content, including but not limited to data cleaning, format conversion, and storage, so that it can be used for the purpose of providing AI Assistant services. XMod will not use User Input Content for model training or provide it to third parties, unless laws and regulations provide otherwise or you separately and individually authorize it.

7.3.3 If you believe that AI Generated Content infringes your lawful rights and interests, including but not limited to copyright, trademark rights, or reputation rights, you may submit a written notice to XMod through the complaint channel announced by XMod. After verification, XMod will take necessary measures in accordance with law, including but not limited to deleting relevant content and disconnecting links.

VIII. [Refunds]

8.1 Refunds for Lifetime Membership

8.1.1 Refund period for Lifetime Membership: the refund period for the game modifier is 10 years, calculated from the time you activate the Lifetime Membership. If the refund period expires, you will be unable to apply to cancel the Lifetime Membership and request a refund from us.

8.1.2 Refund method for Lifetime Membership: you may contact customer service through the game modifier customer service interface to "cancel service and refund". After you complete the corresponding identity verification and refund confirmation process, we will refund your remaining Lifetime Membership service fee within 30 working days.

8.1.3 Refund amount for Lifetime Membership: the Lifetime Membership service fee actually paid by you ÷ (10 years × 365 days) × your remaining days, meaning 3650 days minus the number of days since your Lifetime Membership was activated.

8.1.4 Validity of Lifetime Membership: the refund period is not the validity period of the Lifetime Membership. If you do not choose to cancel the service within the refund period, after the refund period you may still continue to use the Xmodhub Game Modifier subscription service.

8.2 Refunds for Other Memberships

8.2.1 Other Memberships refer to Exclusive Membership and Premium Membership, but do not include memberships on marketing activity pages. The refund rules for memberships on activity pages shall be determined by the rules of the activity pages.

8.2.2 Xmodhub Game Modifier provides a three-day no-reason refund service and supports users applying for a three-day no-reason refund for their first paid order. Refunds must be requested by contacting customer service within 3 days after successful payment; refunds cannot be processed after the deadline.

8.2.3 Refund method for Other Memberships: you may contact customer service through the game modifier customer service interface to "cancel service and refund". After you complete the corresponding identity verification and refund confirmation process, we will refund your membership service fee within 30 working days.

8.2.4 A handling fee of RMB 5 will be deducted from the refund, covering payment channel costs and service processing fees.

8.2.5 Once a first-order three-day no-reason refund is processed, any membership duration obtained in any form shall become invalid.

IX. [Compliance with Local Laws and Regulations]

9.1 During your use of the Xmodhub Game Modifier services, you shall comply with relevant local laws and regulations and respect local morals and customs. If your acts violate local laws and regulations or morals and customs, you shall independently bear responsibility therefor.

9.2 You shall avoid causing Xmodhub to become involved in political and public events because of your use of the Xmodhub Game Modifier services; otherwise, Xmodhub has the right to suspend or terminate services to you.

X. [Jurisdiction and Applicable Law]

10.1 The place where this Agreement is signed is Chengdu High-Tech Zone, Sichuan Province, People's Republic of China.

10.2 The formation, effectiveness, performance, interpretation, and dispute resolution of this Agreement shall be governed by the laws of mainland China of the People's Republic of China, excluding conflict of laws rules.

10.3 Any dispute or controversy between you and Xmodhub arising from this Agreement and/or related to this Agreement shall first be resolved through friendly negotiation. If negotiation fails, you agree to submit the dispute or controversy to the people's court with jurisdiction at the place where this Agreement is signed.

10.4 The headings of all terms of this Agreement are for reading convenience only, have no actual meaning in themselves, and cannot be used as a basis for interpreting the meaning of this Agreement.

10.5 If any term of this Agreement is partially invalid for any reason, the remaining terms shall remain valid and binding on all parties.

XI. [Miscellaneous]

11.1 Xmodhub has the right to change the terms of this Agreement when necessary. You may view the latest version of the agreement terms on the relevant pages of Xmodhub Game Modifier. After the terms of this Agreement are changed, if you continue to use the Xmodhub Game Modifier services, you shall be deemed to have accepted the changed Agreement. If you do not agree to the changes, you should stop using the services and cancel your account before the changes take effect.
